| description | إن استنباط الأحكام من النصوص القانونية يحتاج إلى الإحاطة بالقواعد الأصولية لوجود الشبه بين النصوص القانونية والنصوص التشريعية من حيث أن النصوص التشريعية منها العام والخاص والمطلق والمقيد والدال بالعبارة وبالإشارة وبالاقتضاء وغير ذلك وهذه موجودة في النصوص القانونية. وهذا البحث يبين العلاقة الوطيدة بين أصول الفقه والقانون المدني الأردني من خلال إيراد التطبيقات القانونية على اقتضاء النص عند الأصوليين. اعتمدت الدراسة المنهج الاستقرائي وذلك لاستقراء معنى اقتضاء النص عند الأصوليين وعند المشرع ؛ واستقراء أقوال الفقهاء من كتبهم المختلفة و اعتمدت منهج المقارنة وذلك من خلال مقارنة أراء الفقهاء التي تحتاج إلى تحرير، ونسبها لاصحابها. توصلت الدراسة الى أن الاقتضاء هو إحدى طرق دلالة اللفظ على المعنى عند الأصولين في إثبات الأحكام الشرعية العملية و أن الاقتضاء اما أن يكون من المنطوق أو من المفهوم أو يكون قسيما لهما. أوصت الدراسة بضرورة توجيه طلبة العلم إلى استخراج تطبيقات الدلالات في القانون المدني الاردني بكل فروعه ومقارنتها مع الفقه الاسلامي. |

This research shows the close relationship between the principles of jurisprudence and the Jordanian civil law by listing legal applications on the necessity of the text for fundamentalists. The study adopted the inductive method in order to extrapolate the meaning of the requirement of the text for fundamentalists and the legislator; extrapolating the statements of jurists from their various books. It also adopted the comparative method by comparing the opinions of jurists that need editing, and attributing them to their authors. The study concluded that the requirement is one of the ways to indicate the meaning of the two principles in proving the practical sharia rulings and that the requirement is either operative, understandable, or it is a part of them.
