| description | تعد إقامة السوق المالية الإسلامية إحدى التحديات الكبرى في طريق تطبيق نظريات الاقتصاد الإسلامي، ويعتبر البحث في المعايير والشروط المهنية والفنية علاوة على الشروط الشرعية لإقامة هذه السوق أحد أهم الإشكاليات التي ما زالت بحاجة إلى تقديم رؤى واضحة وتفصيلية لها، في سبيل تقديم نماذج مالية لإدارة الأسواق المالية الإسلامية، وبشكل يجمع بين الربحية الاقتصادية والكفاءة المهنية. ويتناول هذا البحث بيان أهم الشروط المتعلقة بإقامة السوق المالية الإسلامية، مثل: الإفصاح والشفافية، والخلو من الغرر والغبن، وغيرها، وذلك من خلال التعريف بهذه المعايير والشروط وبيان ماهيتها ومقوماتها. وتهدف هذه الدراسة إلى بيان مدى إمكانية تحقيق سوق مالية إسلامية كفؤة، وذات ربحية اقتصادية في حال تحقيق شروطها الأساسية. وتوصلت الدراسة إلى أن إقامة سوق مالية إسلامية تتسم بالمصداقية الشرعية والكفاءة الاقتصادية يتطلب تحقيق مجموعة متكاملة من الشروط الشرعية والمهنية. وعليه، فتوصي الدراسة بضرورة تخصيص شروط إقامة السوق المالية الإسلامية بدراسات متخصصة سبيلا لبناء نماذج، وأدوات مالية إسلامية تلبي حاجات ومقاصد جميع المتعاملين في السوق في إطار المتطلبات الشرعية. |

This research addresses the most important conditions related to the establishment of the Islamic financial market, such as: disclosure, transparency, freedom from fraud and injustice, and others, through the definition of these standards and conditions and indicate what they are and their components. This study aims to show the extent to which an efficient and economically profitable Islamic financial market can be achieved if its basic conditions are met. The study concluded that the establishment of an Islamic financial market characterized by legitimacy and economic efficiency requires the achievement of an integrated set of legitimate and professional conditions.
