| description | يهدف البحث الى بيان الأحكام القضائية المعتبرة في قصص داود وسليمان عليهما السلام بالاخص بيان حكم القضايا التالية: بيان حكم اشتراك القضاة في مسألة واحدة، بيان حكم تعدد القضاة في بلد واحد، بيان حكم تعدد القضاء في المسألة الواحدة. حيث استخدمت الدراسة المنهج الوصفي التحليلي، وذلك من خلال دراسة "أحكام القرآن" المستنبطة من قصتي داود وسليمان -عليهما السلام- في سورتي "الأنبياء" و"ص"اللتين أصّلتا لأحكام متعددة في فقه القضاء. توصلت الدراسة الى النتائج التالية: اشتراك القضاة في المسألة الواحدة أمر جائز، اجتماع أكثر من قاض في مكان واحد بل وفي اختصاص واحد أمرٌ جائز، فسليمان كان قاضيا كداود عليهما السلام واجتمعا، حكم القضاء قد يتعدد في المسألة الواحدة فيكون حينئذ أكثر من حكم صحيح، وللقاضي أن يحكم بما يراه الأرجح والأوفق لحال الخصوم. أوصت الدراسة بضرورة الرجوع إلى أحكام القرآن الكريم في مختلف أبواب الفقه. كما أوصت بإنشاء الدراسات القائمة على القصص القرآني الذي احتلّ ربع آيات القرآن الكريم، باستنباط الفوائد والأحكام مختلفة الموضوعات. |

The study used the analytical approach to study the provisions of the Qur'an deduced from the stories of Dawoud and Sulaiman - peace be upon them - in the Al-Anbiya and Saad Surahs, which are the basis of various provisions in the jurisprudence of the judiciary. The study found that the participation of judges in the same issue is permissible, the meeting of more than one judge in one place and even in one jurisdiction is permissible, Suleiman was a judge like David and they met, the judgment of the judiciary may be multiple in one issue, then there will be more than one correct judgment, and the judge may rule on what he deems most likely and most favorable for the case of the opponents. The study recommended the need to refer to the provisions of the Holy Quran in various sections of jurisprudence.
