The study aims to show the foundations adopted by the Maliki School for recognizing statements through weak opinions, such as istihsan and considering differences. Also, it aims to show the role of usuli scholarship in reducing jurisprudential disagreement between schools of thought in general and within the school of Maliki in particular. Methods: The study follows narration-method in terms of presenting the texts and the inductive method in terms of collecting materials from Maliki sources and other Traditions’ books. Also analytical method is used to analyze and discuss the opinions of scholars. Results: The study found that the Maliki establishes “prevailing view which is based on a weak saying” through a variety of jurisprudential foundations; most important of which are istihsan and considering differences. Additionally, the study shows the important role of these foundations in finding common grounds amongst Maliki scholars and amongst other schools of thought generally. The study indicates that looking at the consequences has an impact on establishing the famous view on a weak statement.
