| description | الأهداف: تهدف الدراسة إلى بيان مفهوم مسألة "في نفس الأمر"، ومذاهب الفلاسفة المتقدمين والمتأخرين فيها، مع توضيح طرائق ثبوت القضايا، ومعيار صدقها، وصلتها بمسألة "نفس الأمر"، والإشارة إلى علاقة تلك المسألة في بعض الفلسفات المعاصرة، ومدى تأثيراتها في مسائل متعلقة بأصول الدين وفروعه. المنهجية: اتبعت الدراسة المنهج الاستقرائي بتتبع المسألة وجمعها من المصادر الفلسفية والفقيهة والأصولية المعتمدة، بالإضافة إلى المنهج التحليلي بمقارنة النصوص وتحليلها ومناقشتها. النتائج: توصلت الدراسة إلى أن ضابط إصابة ما "في نفس الأمر" في مسائل أصول الدين-عند أغلب علماء المِلّة- هو موافقة عيْن ما عند الله تعالى -وهو الإسلام-، وأما في الفروع، فإن مفهوم "نفس الأمر" يتمحور حول مطالبة المكلف بإصابة ما عند الله تارة، أو بإصابة ما في ظن المجتهد، مما يعني أن أقوال المجتهدين التي بُنيت على أصول مُحكمة، ومنهج علمي رصين، قد أصابت نفس الأمر، فمعيار صدقها هو سيرها على ذلك المنهج، كما انتهت الدراسة إلى أن صياغة الأصوليين لمفهوم "العلم" جاءت متوافقة مع ما ذهب إليه العلماء في بيان ماهية "نفس الأمر"، فالعلم هو: "معرفة المعلوم على ما هو به" (وما هو به) يتناول إصابة ما عند الله، وما في ظن المجتهد، وكل منهما هو نفس الأمر في المسألة الاجتهادية الفرعية، وخصوصًا عند المصوبة. الخلاصة: انتهت الدراسة إلى إظهار تميز منهج متكلمي المسلمين في إعادة صياغة المصطلحات المنطقية وصبغها بقيود شرعية، كما في القيود التي أضافوها لنفس الأمر أثناء تطبيقه في الفروع والأصول، إذ جعلت ضابط "نفس الأمر" هو موافقة الشرع، لذا توصي الدراسة بمزيد من البحث للموضوعات المنطقية، وبيان استيعاب الأصوليين لها، بإضافة الصبغة الشرعية عليها. |

It examines the relationship between these philosophies and contemporary thought, along with their effects on the origins and branches of religion. Methods: The study employs a transmission approach to present relevant texts, an inductive approach to trace and collect information from approved sources, and an analytical approach to compare, analyze, and discuss the texts. Results: The study concludes that, according to most religious scholars, the concept of “the matter” in the context of religiou s fundamentals refers to the essence of what God Almighty has decreed, which is Islam. In the branches of jurisprudence, the “same matter” pertains to the responsibility of the accountable person to fulfill what God has prescribed at certain times, as interpreted by the diligent individual. The study also demonstrates that the formulation of the concept of “knowledge” by fundamentalists aligns with the scholars' understanding of the essence of the same matter in both its principles and branches. Conclusion: The study highlights the excellence of Muslims in formulating logical terms, including the distinctions they made in relation to the subject. It concludes by showing how philosophical terms were adjusted to fit legal standards.
