| description | هدفت الدراسة إلى بيان معنى التعارض بين النصوص وأسبابه وكيفية التعامل مع التعارض الحاصل بين النصوص. فتطرقت الدراسة إلى معنى التعارض لغةً واصطلاحًا، أسباب التعارض، وكيف يتم إزالته. تتجلى أهمية البحث في تنزيه الشريعة عن التعارض، وبيان كونه ظاهريًا، وتوضيح موقف العلماء من النصوص المتعارضة ظاهرًا، وذلك لأنه في هذه الايام يتم التلاعب فيه دين الله تعالى لصرف المسلمين عن دينهم. تم استخدام المنهج الاستقرائي التحليلي وذلك من خلال استقراء الأسباب المحتملة للتعارض بين النصوص، وتحليلها، ثم الكشف عن طريقة فهمها. تم دعم التحليل من خلال أمثلة من الآيات والأحاديث. ونتجت الدراسة إلى أن التعريف الأشـمل للتعارض عند الأصوليين هو التقابل بين الأدلة الشرعية. كما نتجت الدراسة إلى أن للتعارض أسبابًا عدة من أهمها: تغير الحكم والتنوع في الحكم. كما خلصت إلى تغاير الحكمين لتغاير الحالتين، فيحمل كل نص على حالة بعينها. توصلت الدراسة إلى أن التعارض يعالج بطرق شتى كالنسخ، أو الجمع، أو الترجيح إن تعذر كل منهما. |

The study touched on the meaning of the conflict, linguistically and idiomatically, the causes of the conflict, and how to eliminate it. The inductive-analytical approach was used by extrapolating the possible causes of conflicts between texts, analyzing them, and then revealing the way of understanding them. The analysis was supported with examples of verses and hadiths. The study concluded that the most comprehensive definition of the conflict among the fundamentalists is the contrast between the legal evidence. The study also concluded that there are several reasons for the conflict, the most important of which are: change of provision and diversity in provision. It also concluded that the two provisions differed because the two cases differed, so that each text was applied out on a specific case.
