| description | يُعَدُّ الحقُّ في الحياة الخاصّة من الحقوق الدستوريّة الأساسيّة الملازمة للشخص الطبيعيّ بصفته الإنسانيّة كأصل عام، وهو عصبُ الحريّة الشخصيّة، وركيزة أساسيّة لحقوق الإنسان والحريات العامّة، وأساس بنيان كلِّ مجتمع سليم. وتبعًا لذلك، يقتضي هذا الحقُّ احترامَ السُّلطة والأفراد، كما يقتضي -في الوقت نفسِهِ- أن تكفل له السُّلطاتُ الحماية الدستوريّة والقانونيّة ضدّ الانتهاك غير المشروع. وقد تضمّنت أحكامُ الشريعة الإسلاميّة العديد من الأحكام الشرعيّة التي تحثّ على وجوب احترام خصوصيّة الإنسان وكرامته، كما عُدَّت إعلاناتُ حقوق الإنسان من أهمّ عناصر التطوّر التاريخيّ لِحَقِّ الإنسان في حُرمة حياته الخاصّة. وعليه، فقد أولت التشريعات الأردنيّة أهميّة خاصّة لِحُرمة الحياة الخاصّة، فقرّرت المادة (7) من الدستور الأردنيّ لسنة 1952 وتعديلاته لسنة 2011 أنّ "كلّ اعتداء على الحقوق والحريات العامّة أو حُرمة الحياة الخاصّة للأردنيين جريمةٌ يُعاقِبُ عليها القانون". وقد جَمَعَ المُشَرّع الأردنيّ بين نوعين من حماية حُرمة الحياة الخاصّة؛ أوّلهما الحماية المدنيّة التي تهدف إلى تعويض المتضرّر، وثانيهما الحماية الجزائيّة المتمثلة في العقاب الجزائيّ التي تهدف إلى إصلاح الضّرر. وتعالج هذه الدراسة مدى ملاءمة القواعد القانونيّة التي أقرّها المُشَرّع الأردنيّ للحماية من الاعتداء على حقّ الإنسان في الحياة الخاصّة، سواءٌ أكانت تلك الواردة في الدستور أم في القانون المدنيّ أم في القانون الجزائيّ. |

Accordingly, this right requires respect for authority and individuals, and at the same time requires that the authorities guarantee constitutional and legal protection against unlawful violation. The provisions of the Islamic Sharia have included many Sharia provisions that urge that human privacy and dignity must be respected, and the declarations of human rights are considered one of the most important elements of the historical development of the human right to privacy. Article 7 of the Jordanian constitution of 1952 and its amendments of 2011 stipulates that "any attack on public rights and freedoms or the inviolability of the private life of Jordanians is a crime punishable by law". The Jordanian legislator has combined two types of protection of the inviolability of private life; the first is civil protection, which aims to compensate the injured, and the second is Penal protection, represented by penal punishment, which aims to repair the damage.
