In addition, the study included mentioning cases of dropping custody, and the time of expiry, while comparing them with the Kuwaiti Personal Status Law. The research was based on the inductive method by extrapolating the books of Maliki jurisprudence and the provisions of custody. It was also based on the comparative approach by comparing the provisions of custody according to the Maliki school of thought, and the provisions of the Kuwaiti Personal Status Law regarding custody. This is in addition to the analytical approach by studying the concept of custody provisions, then clarifying the related provisions of the Kuwaiti Personal Status Law. The research concludes with a statement of the role of Islamic law on the Muslim family, through the legal provisions that preserve the rights of the individual, including the provisions of custody that guarantee the right of the child when he/she is young.
