| description | الأهداف: تهدف الدراسة إلى إبراز عناية الإمام الكاساني بالضوابط الفقهية في كتابه بدائع الصنائع، بالإضافة إلى إثراء علم الضوابط الفقهية بذكر صيغ جديدة مستخلصة من باب الطلاق من كتاب بدائع الصنائع، مع بيان المقصود بهذه الضوابط، وإيراد الأدلة التي تستند إليها، وذكر أبرز التطبيقات والاستثناءات الواردة عليها. المنهجية: اتبعت الدراسة المنهج الوصفي القائم على الاستقراء والتحليل والاستنباط، وذلك من خلال استقراء كتاب الطلاق من بدائع الصنائع ثم استخلاص أبرز الضوابط الفقهية التي ذكرت فيه، وتحليلها المتمثل في بيان معنى الضابط وتطبيقاته واستثنائته، ثم استنباط الدليل الذي يرجع إليه الضابط الفقهي. النتائج: الضوابط الفقهية لا حصر لها، إذ هي كثيرة جدًا ومنثورة في كتب الفقه، وقد استفاد الإمام الكاساني في تقرير الضوابط الفقهية في كتابه بدائع الصنائع بمن سبقه من فقهاء المذهب الحنفي، وبالإضافة إلى ذلك كان له جهد بارز في تقرير ضوابط فقهية لم يُسبق إليها. وقد أورد الإمام الكاساني الضوابط الفقهية في كتابه بدائع الصنائع من خلال التنبيه إلى علة المسألة التي هي في الحقيقة مبناها الفقهي، أو بذكر ذلك صريحًا حيث يرد المسألة إلى أصلها الفقهي بعد ذكرها. وقد نتج عن الدراسة استخلاص ثلاثة عشر ضابطًا فقهيًا متعلقًا بألفاظ الطلاق، الطلاق بالعدد، الطلاق المعُلًّق على شرط، والاستثناء في الطلاق. الخلاصة: الأهمية البالغة التي يحويها كتاب بدائع الصنائع في اعتنائه بالضوابط الفقهية والذي تمثل بما أوردته هذه الدراسة من ضوابط في باب الطلاق، والاستفادة منها في الدرس الفقهي وفي صياغة قوانين الأحوال الشخصية. |

The study also mentions the most vital applications and exceptions to such regulations. Methods: The study follows the descriptive approach based on induction, analysis, and deduction, based on the chapter of divorce in Bada’i’ al-Sana’i’ book. The most prominent jurisprudential regulations therein are extracted and analysed by explaining their meaning, applications and exceptions. The study then deduces the evidence that the jurisprudential regulation is based upon. Results: Jurisprudential regulations are countless and are scattered throughout the books of jurisprudence. In determining the jurisprudential regulations in his book Bada’i’ Al-Sana’i’, Imam Al-Kasani benefited from the jurists of the Hanafi school before him. Moreover, he made a notable effort in establishing unprecedented jurisprudential regulations. Imam Al-Kasani referred to these regulations in the aforementioned book by pointing out the source problem, or by pointedly referring the issue to its jurisprudential origin. This study has resulted in the extraction of thirteen jurisprudential regulations on divorce terms, divorce by number, conditional divorce and the exception in divorce.
