| description | تقوم النازلة على بيان أهميتها في الاجتماع الإسلامي، وخاصّة البلاد المغاربية؛ إذ إماطة اللثام عن دورها والمنوط بها ببيان كوائن العمران وأسباب انتكاسه، وهي بيان لعوائد تلمسان وأحوال الناس آنذاك، بحيث تثري مساحة فقه المحلّ لا فقه الحكم، وتنشُد الخلاص من ربقة الفقيه المقابس والأكاديميّ المترحِّل. تهدف الدراسة الى محاولة التعرُّف على النازلة ودورها في إخصاب المادة التاريخية رغم ما يُقال من معوقات تسهم في توطين وتحيينها وصعوبة لغتها الفقهية. قامت هذه الدراسة على المنهج الاستدلالي من خلال تنقيبات نصية في الجهد المشار اليه بوسمه. استخدمت الدراسة كلمات مفتاحية كعلوم اللسان، والمدرسة النقدية الحداثية من مثل: النص المولَّد، التناص، الجملة العامل، الجملة المنطلق، الجملة الهدف و ناقشت علاقتها بالنازلة. قسمت الدراسة الى مبحثين رئيسان و هما: أدبيات الدراسة وإطارها النظري و المجال التكويني للنازلة الفقهية "تاريخًا". أوصت الدراسة على أهمية سحب النوازل الفقهية إلى تاريخيتها، بحيث نوسع من علمّية الفقه في بابه إلى أن يكون وثيقة في السجل التاريخي العربي. |

It will explain the role of the problem on the catastrophic status of urbanization and the reasons behind its relapse. The city of "Talmasan" and the situation of people at that time will be used as a case study. The results will enrich jurisprudence (FIQH) of the place over the regular jurisprudence (FIQH). The analysis is a new approach which does not depend on the approach of quotation of the regular jurist (FQIH) or migrant academician. The aim of the study is trying to identify the Descendents and their role in the enrichment of historical material, despite what is said of the obstacles that contribute to localizing and reviving them and the difficulty of their Fiqh language. This study was based on the heuristic method through textual excavations in the effort referred to by his name. The study used key words like the sciences of language, and the modern critical school such as: the generated text, intertextuality, the working sentence, the starting sentence, the target sentence and discussed its relationship with the descending. The study was divided into main sections namely: the literature of the study and its theoretical framework and the formative field of the Fiqh "history".
