| description | الأهداف: تهدف هذه الدراسة إلى بيان وإيضاح أحكام خيار فوات الوصف وأثره في عقود المعاوضاتِ، مُتَّخِذَةً الإجارة والبيع ميدانًا لهذا البحثِ، عبرَ بيانِ أقسامِ هذا الخِيارِ وأثرهِ في لزومِ عقدَيِّ البيع والإجارةِ. المنهجيّة: استخدمت الدراسة المنهج الاستقرائي، وذلك عبر تتبّع المادة العلمية وجمعها من مظانها المختلفة التي يحتاج إليها في هذه الدراسة. والمنهج التحليلي، من خلال عرض المذاهب الفقهية، واستجلاء أدلتها، وما يرد على هذه الأدلة من مناقشات وإيراداتٍ - إنّ ورد ذلك - وصولاً إلى ترجيح ما يظهر بالدليل رُجحانه. النتائج: توصَّلَتْ الدراسةُ إلى أنّ الأصل في العقود الصحة واللزوم، وأنّ عدم اللزوم بسبب الخيار هو أمر عارض جاء لمعالجة أوضاع خاصة. وأن استحقاق المشتري والمستأجر الأرش بسبب فوات الوصف المرغوب في السلعة المباعة أو العين المستأجرة، إذا رضي كلٌ منهما بإمضاء العقد ولم يستعمل حقه في الفسخ. الخلاصة: أوصت الدراسة على ضرورة إجراء المزيد من الدراسات حول أثر خيار فوات الوصف في غير البيع والإجارة من عقود المعاوضات، كالاستصناع والسلم باعتبارهما من البيوع التي تنفرد بأحكام خاصة يمكن أن يكون لخيار فوات الوصف في هذين العقدين وغيرهما أحكام خاصة تختلف عن أحكام البيع عموماً. |

This will be achieved by identifying the relevant sections pertaining to this option and its impact on the necessity of sale and lease contracts. Methods: The study used an inductive method to gather relevant scientific material from different sources necessary for this research. It also employed an analytical approach by presenting the doctrines of jurisprudence, clarifying their evidence, and discussing and indicating any evidence to determine what appears to be correct based on the evidence. Results: The study concludes that the foundation of contracts is reliability and necessity, and the option to waive the description requirement is incidental and used to address special situations. The buyer and lessee are entitled to compensation for the loss of the desired description of the goods sold or leased entity if they consented to the contract's signing and did not use their right of avoidance. Conclusions: The study recommends conducting further research on the impact of the loss of the description option on non-sale and lease netting contracts, such as Istisna'a and Salam sales that have their unique provisions.
