| description |
This conference contribution was presented by Muhammed Jaseem, Darul Huda Islamic University, India. (International Conference on Debate and Dialogue. An Initiative of QatarDebate 2025).

Islamic law schools often hold divergent opinions on the same issue. Shafi'i and Hanafi schools rely on linguistic arguments to interpret Sharia, resulting in differing legal interpretations. Focusing on the term lams (سمل, touch), this study examines how linguistic decisions shape legal choices. Using qualitative analysis of legal works, it explores tools like ijtihād (independent reasoning) and qiyās (analogical reasoning). The Hanafi school emphasizes grammatical structures, while the Shafi'i school focuses on textual analysis. Findings confirm linguistic differences significantly influence legal interpretations, highlighting language's role in shaping Islamic law and suggesting avenues for addressing contemporary issues.

Other Information

Conference information: The 2nd International Conference on Debate & Dialogue : An Initiative of QatarDebate (19 - 20 May 2025, Qatar National Conventions Center - QNCC, Doha - Qatar)
License: https://creativecommons.org/licenses/by/4.0/

See the conference information on the organizer's website: https://qatardebate.org/programs/academic-programs/2nd-icdd/
|
