| الملخص: | Even though it is a vital contributor to economic development, the construction industry in the UAE is still confronted with continuous stakeholder disputes, which can be costly and damaging to relationships. Most issues stem from ambiguity in contracts, payment disputes, project delays, quality control issues, and regulatory barriers. This dissertation examines prevalent issues in the construction industry of the UAE; investigates their underlying reasons such as the legal intricacies, financial limitations, and communication problems; and assesses the mediation, arbitration, litigation, and Alternative Dispute Resolution (ADR) techniques that have been employed to resolve these disputes. Along with examining how industry best practices, such as proactive risk management and improved contract clarity, might lessen conflicts, this study assesses how well-suited the current legal frameworks and contractual processes are for resolving disputes. The analysis of practical legal experience and relevant literature shows that there are many practical ways to shorten disputes and improve resolution strategies. By establishing effective ADR systems and encouraging a culture of negotiation, the construction industry in the UAE can improve its efficiency, minimise conflicts, and support sustainable development. To turn the UAE's construction sector into a model of effectiveness, resilience, and long-term growth, a forward-thinking strategy that incorporates cutting-edge technologies, transparent legal frameworks, and cooperative dispute resolution procedures would be essential. |
